Giveaway Terms & Conditions

Please read these Terms & Conditions carefully before entering the 540Giveaways giveaway. By participating, you agree to be bound by these terms.
1. Sponsor
This giveaway is sponsored by 540Giveaways, based in Virginia ("Sponsor"). The Sponsor is solely responsible for the administration of this giveaway. This giveaway is not sponsored, endorsed, administered by, or associated with any social media platform, including but not limited to Instagram, TikTok, Facebook, or X (formerly Twitter).
2. Eligibility
This giveaway is open to legal residents of the United States, who are 18 years of age or older at the time of entry, excluding residents of Florida, New York, Rhode Island, Alaska, Hawaii, and all U.S. territories (including Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands). Void where prohibited by law. Employees, officers, and directors of 540Giveaways, and their immediate family members, are not eligible to participate.
3. Giveaway Period
The giveaway begins on July 16, 2026 and ends on September 1, 2026 at 11:59 PM EDT. All entries must be received before the end date and time to be eligible.
4. How to Enter
There are two ways to enter this giveaway:
Option A: Purchase Entry (Paid)
Purchase a digital entry product from 540Giveaways. Each qualifying purchase earns the participant entries into the giveaway draw. The number of entries per purchase will be stated on the product or promotional page. Limit: One (1) or more entries per eligible purchase, as specified. Participants may earn multiple entries through multiple qualifying purchases.
Option B: Free Email Entry (No Purchase Necessary)
No purchase is necessary to enter or win. To enter for free, send an email to tyeshopbusiness@gmail.com with the subject line "Free Entry - 540Giveaways" and include the following information in the body of your email:
- Your full name
- Your email address
- Your state of residence
Each email submission counts as one (1) entry. Limit of one (1) free email entry per person per day. Free entries must be received by September 1, 2026 at 11:59 PM EDT to be eligible. Entries that are incomplete, illegible, or do not follow the instructions will be disqualified.
Entry Processing & Tracking: All valid free entries are manually logged by 540Giveaways and entered into the same draw pool as paid entries. Each free entry is assigned an equal chance of winning as any paid entry of the same quantity. 540Giveaways will make reasonable efforts to confirm receipt of free entries; however, we are not responsible for emails that are lost, delayed, or undelivered due to technical issues. Entrants are encouraged to retain a copy of their submission for their records. If you do not receive a confirmation within 5 business days of submission, you may follow up at tyeshopbusiness@gmail.com.
A purchase does not improve your chances of winning over a free entry of equal quantity.
5. Prize
The prize for this giveaway is one (1) Apple AirPods Pro (3rd Generation). The prize is non-transferable and cannot be exchanged for cash or any other item. 540Giveaways reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable.
6. Winner Selection
The winner will be selected by a random number generator from all eligible entries received during the giveaway period. The draw is conducted to ensure a fair and unbiased result. All entries have an equal chance of being selected.
The draw will take place after the giveaway closes on September 1, 2026. The winner will be notified via the contact information provided at the time of entry.
7. Winner Notification & Claiming the Prize
The selected winner will be contacted within 7 days of the draw. The winner must respond within 48 hours of notification to claim their prize. Failure to respond within this timeframe may result in forfeiture of the prize and selection of an alternate winner.
8. Odds of Winning
The odds of winning depend on the total number of eligible entries received during the giveaway period.
9. General Conditions
- 540Giveaways reserves the right to cancel, suspend, or modify the giveaway at any time if fraud, technical failures, or any other factor impairs the integrity of the giveaway.
- By entering, participants agree to release and hold harmless 540Giveaways from any liability arising from participation in the giveaway or acceptance of a prize.
- Tax Responsibility: All federal, state, and local taxes on prizes — including applicable income taxes — are the sole responsibility of the winner. Prize winnings may be considered taxable income under U.S. federal and state law. Winners are solely responsible for reporting and paying any taxes owed on the prize. 540Giveaways is not responsible for any tax liability incurred by the winner.
- This giveaway is in no way sponsored, endorsed, administered by, or associated with Apple Inc. or any other third party.
10. Publicity Release
Except where prohibited by law, by accepting a prize, the winner grants 540Giveaways permission to use their name, general location (city and state), and likeness for promotional and advertising purposes in connection with this giveaway, without additional compensation. This includes but is not limited to announcements on our website, social media channels, and email communications. Winners who do not wish to participate in promotional activities should notify 540Giveaways in writing at the time of prize acceptance.
11. Privacy, Marketing Consent & Data Retention
Personal information collected in connection with this giveaway (including your name, email address, and state of residence) will be used solely for the purpose of administering the giveaway and will not be sold or shared with third parties, except as required by law.
Marketing Communications: By entering this giveaway, you may receive occasional promotional emails from 540Giveaways about future giveaways, new prizes, and store updates. You can opt out of marketing communications at any time by clicking the "unsubscribe" link in any email or by contacting us directly at tyeshopbusiness@gmail.com. Opting out of marketing emails will not affect your entry into the current giveaway.
Data Retention: We retain personal information collected during the giveaway for a period of 90 days following the close of the giveaway, after which it will be securely deleted, unless we are required by law to retain it for a longer period. Winner information (name only) may be retained for a reasonable period for record-keeping and promotional purposes. You may request deletion of your personal data at any time by contacting us at tyeshopbusiness@gmail.com.
12. Governing Law
This giveaway is governed by the laws of the Commonwealth of Virginia and the United States. Any disputes arising from this giveaway shall be resolved in accordance with applicable Virginia and federal law.
13. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to this giveaway or these Terms & Conditions shall first be attempted to be resolved through good-faith informal negotiation. You agree to contact us at tyeshopbusiness@gmail.com and give us 30 days to resolve the issue before pursuing any formal action.
If the dispute cannot be resolved informally, you agree that it shall be resolved by binding arbitration administered in Virginia, in accordance with applicable arbitration rules, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit. The arbitrator's decision shall be final and binding.
For the avoidance of doubt, 540Giveaways retains the right to cancel, suspend, or modify the giveaway at any time if fraud, technical failures, or any other factor impairs the integrity of the giveaway, and such actions shall not be subject to arbitration.
Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
